When your package arrives, we are committed to moving it through the receiving, analysis, and settlement process in less than 24 hours. Once the items in your shipment are analyzed and verified, You will be immediately informed of it’s value.  If You should disagree with our assessment of the shipment’s value and you'd like us to return it, we will return your items to You within three (3) business days at our expense.

Conditions of Sale

Precision Refining, Ltd. is a company, to whom You offer to sell to Precision Refining your gold, platinum, and other precious metals product (Product).  By using the Precision Refining web site and participating in the service, You agree to the terms and conditions set forth herein. These terms are a legal Agreement between You, and Precision Refining, and are collectively referred to herein as the “Agreement.”

As a condition of utilizing the functions and services provided to You by this Site, You must read and agree to be bound by all the terms and conditions contained in this Agreement. Should You access any area of the Precision website, use any tools, functions or services that the Site offers, view any text or graphics published on this Site, or use any of our services, by either clicking SUBMIT on the Precision Refining website or by telephoning, faxing, emailing, or writing to Us to make that request, confirms that You have read this Agreement and agree to be bound by the terms and conditions contained herein.

Should You not agree to be bound by all the terms and conditions contained in this Agreement, You must refrain from engaging in any business activity with Precision Refining or contact Us to request information, product or services.

Precision Refining Home Gold Parties Authorization and Contract

By signing and submitting the Precision Refining Gold Home Party Agreement (“Agreement”), you are applying for legal authorization to become an independent contractor representative of Precision Refining, Ltd. Before an individual(s) can represent Precision Refining as an independent contractor and conduct a Precision Refining Gold Party, a representative of Precision Refining Ltd, an Illinois Limited Liability Company must approve the individual’s application by signing and dating the Agreement. You acknowledge that prior to signing and submitting the Precision Refining Gold Party Independent Representative Agreement, you have read and agree to all terms set forth in the Agreement.

You further understand that additional merchandising and support items to conduct a Precision Refining Gold Home Party are available for purchase from the Precision Refining website. However, the purchasing a Precision Refining Home Party Kit does not grant approval or permission from Precision Refining Ltd for you or anyone else on your behalf to conduct a Precision Refining Gold Home Party.

Precision Refining reserves the right to reject any application for any reason upon review of the completed application. The terms and conditions of your retention as an independent contractor representative of Precision Refining, Ltd. to conduct a Precision Refining Gold Home Party shall commence on the date of written approval by Precision Refining Ltd, approving you as an independent contractor representative and shall continue indefinitely, unless terminated sooner per the Agreement or by otherwise by law. In no case shall approval be granted prior to Precision Refining Ltd’s receipt of the signed License Agreement from you.

Tracking Your Shipment / Notification of Settlement

Your entire shipment can be tracked online utilizing the tracking number we provide with your return gold kit. The tracking number will allow You to track your shipment from the initial receipt of your product at Precision Refining, through all phases of the analysis process, and the final settlement. Don’t worry if your forget to track your shipment online, we’ll be emailing You updates periodically through the entire analysis process. 

Once the analysis is complete – generally within 6 hours following receipt of your Gold Return Kit at our offices – we will notify You regarding your payment amount by way of email. If an email address has not been provided, we will attempt to contact You by telephone. 

Once You are contacted through email, or orally with the settlement amount, You then have the option to accept the offer or ask that we send your material back. If we do not hear from You within 24 hours upon notification, we will issue your check and send it to You by First Class Mail, It’s that easy.

In most cases, You will receive a Precision Refining check within 48 - 72 hours after the settlement amount has been determined.

If You elect to have the funds paid via a wireless transfer, You will need to provide Precision Refining with all wire transfer information along with your submission of item(s).  Precision Refining will not be responsible for any wire transfer fees charged to You by your bank. Because banks may have their own rules, regulations and fees applicable to wire transfers, please contact your bank to ensure that You wire transfer information You provide Precision Refining is accurate.

Removing Stones From Your Product

It is recommended that You remove any valuable stones from your material before the product is sent to Us for refining. Stones and other material will not be recovered or saved during the refining process.

By sending Precision Refining your product, You agree to release Us from any claim or liability as to the product, any stones set in such product or any intrinsic value of such product, provided Precision Refining accepts Your Product and provides You payment per this Agreement.

150% Cash Back Guarantee

If You receive a higher offer somewhere else, we will pay our original offer plus 150% of the difference between the two offers after comparing the competing firm precious metal return against the material originally sent to Us for analysis.

If all the terms and conditions are satisfied according to our web site written Agreement, Precision Refining will issue a check for our original offer plus 150% of the difference between the two offers.

Changed your Mind?

If for any reason You should change your mind about selling your material to Precision Refining You must notify Us immediately in writing at canceltransaction@precisionrefining.com.

If a check has been processed and sent, You will need to return the unprocessed check immediately to Precision Refining at the address as listed on the check. We hold all product for 14 days from the date the check is issued to You. After 14 days of issuing the check, your material will be processed for refining and we will not be able to return your material. Precision Refining is not liable for loss or damages resulting from the checks not returned and product processed for refining within the time limits as described above.  

Gold Valuation Chart

Precision Refining provides a gold chart with written content to allow You to estimate value of your precious metal return. The charts are provided as general information, updated periodically and should be used as a guide only. Many factors determine the value of your shipment including but not limited to estimating the metal weight of stone set product, testing the purity of the marked or unmarked material, attachments and/or other components. Precision Refining shall not be held liable for damages or any other liability to any customer who relies upon the gold chart information to determine their settlement.

The prices we pay do not reflect retail prices that often carry a very high markup. Our settlement is calculated and determined by the estimated weight of the precious metal in the Product.

Product Inspection

All products sent to Us for analysis are visually inspected, video recorded and imaged upon receipt at Precision Refining. Precision Refining reserves the right to accept or deny the Product. If denied, Precision Refining will arrange for the return of the Product to You at the address from which it was originally sent. It is agreed by the seller that the product being sent to Precision Refining is intended by the seller to be refined and that the material has a no intrinsic value.  Packing and shipping recommendations should be followed to avoid possible damage or loss during transportation.

Product Valuation and Settlement

All quotes will be based on Precision Refining's own determination of the Product’s value after receipt of your parcel. Precision Refining will use its best discretion to determine the product value, which includes estimating the precious metal weight due to stones and other non-precious materials or components set in your product as well as verifying the value through numerous other testing methods. Upon receiving your quote, You have the option of offering for sale your product to Precision Refining. Once accepted, You will have the option of accepting the offer on-line, through email, or verbal communication in which Precision Refining reserves the right to record the conversation. Once our settlement offer is accepted, You will have fourteen (14) days from issuance of the Precision Refining check to cancel the transaction in writing requesting that we return the product to You. 

Precision Refining will settle gold daily at the 2nd London Close. The London gold fixing is a clearly posted quoted price for gold that occurs twice a day. The objective in establishing this standard is to allow large quantities of gold to bought and sold using a single price. Most industry participants such as the mines, refiners, fabricators, and banks use it as a basis for daily transactions.

Product Ownership

You must be at least 21 years of age, own the right, title, and interest in any and all items You seek to sell to Precision Refining. You must also be acting on your own behalf, and not as an agent or representative of another individual or company. Such items, or the sale and shipment of such items, must not violate any applicable laws, statutes, ordinances, or regulations including export laws. You are responsible for complying with any and all such laws. Any items You seek to sell through the Site using Precision Refining services: (1) shall not infringe on third party intellectual property rights (including copyrights, trademarks, patents, trade secrets or other proprietary rights), (2) shall not be counterfeit, stolen, or fraudulent. You represent and warrant that the products are free of any liens or encumbrances.

By using the Precision Refining service, you agree to indemnify Precision Refining from all claims or losses sustained by Precision Refining as a result of any breach of this warranty.

Passing of Title

Title of the product passes to Precision Refining upon the acceptance of our offer on-line or, through other email or recorded verbal communication. Once a settlement is made, You will have 14 days from issuance of the Precision Refining check to cancel the transaction in writing or by way of email and request that we return the product to You.  All email cancellations should be directed to canceltransaction@precisionrefining.com

If Precision Refining does not accept the product after our initial inspection and valuation or, for whatever reason, the product will be returned and the title shall not pass to Precision Refining and shall remain with You.

Wire Transfer of Funds

By selecting the payment of your settlement by a wire transfer into your bank, You acknowledge and agree that You affirmatively accept the settlement, the transaction is final. The passing of the title of your product is granted to Precision Refining once the wire transfer is completed. You will have no right to decline the settlement or claim and that the merchandise be returned to You.  The merchandise at this point will be destroyed through our refining process.

Acknowledging your desire to wire transfer funds as settlement can be made by returning the Precision Refining form with your shipment clearly indicating your desire for the wire transfer.   Precision Refining will only accept written or email communication confirming the wire transfer as your settlement preference. Wire transfers are often subject to bank restrictions and deadlines for transfer of funds. Precision Refining is not monetarily responsible for wire transfer transactions that are delayed due to banking or financial institution policies.

You acknowledges that by agreeing to a wire transfer of funds, the funds are being transferred to your personal or business account. If You elect to have the funds paid via a wireless transfer, You will need to provide Precision Refining with all wire transfer information along with your submission of item(s). Precision Refining will not be responsible for any wire transfer fees charged to You by your bank. Because banks may have their own rules, regulations and fees applicable to wire transfers, please contact your bank to ensure that You wire transfer information You provide Precision Refining is accurate.

All wire transfers of funds will be subject to a $9.99 charge from Precision Refining. This amount is deducted from the final settlement. The wire transfer of funds are only available on final settlements exceeding $100.00. 

Shipping Your Product to Precision Refining

Precision Refining utilizes and recommends the USPS and Federal Express as our preferred carriers. The Gold Return Kit You request will include a prepaid Tyvek security envelope to return your items via the United States Postal Service (USPS) Precision Refining for processing. This is the most common form of shipping product to Precision Refining.

If your shipment requires a larger outer shipping container, You may download and print a prepaid Federal Express air bill on-line by clicking the Federal Express button on the Precision Refining website. With our shipping label You may either pack your items in your own shipping carton or, use a box provided to You free at any Federal Express Ship Center. All Federal Express shipments utilizing our downloadable prepaid label require that You drop the package off at the nearest Federal Express Ship Center or Federal Express Drop Box.

All shipping costs are prepaid when You use our USPS provided envelope or the Federal Express downloadable label with the packaging provided by Federal Express or yourself.  All customer USPS and Federal Express shipments are insured for up to $120.00 at no additional cost. If You wish to insure their package being sent to Precision Refining in excess of $120.00, additional insurance must be purchased by the customer at their sole expense. Shipping of Parcels from Precision Refining

If You elect to have Precision Refining return your shipment for any reason, Precision Refining will insure the parcel for 120% of the liquidation value as previously established and communicated in writing by Precision Refining. Customer agrees to waive any additional losses not covered by the amount of insurance purchased by Precision Refining at its sole discretion.  An image, illustrating the initial receipt of the product will be included with the return.

Precision Refining reserves the right to choose the return carrier, insurance provider and signature or receipt verification method for the shipment.  In the event the items returned to the customer are lost in transit, the customer’s sole remedy is to seek reimbursement through the insurance carrier and such losses and claims are subject to the terms and conditions of the insurance carrier and the additional insurance purchased by Precision Refining on the customer’s behalf if any, or the liquidation value determined by Precision Refining whichever is greater.

If additional insurance coverage is requested on the return of your product, You will be notified of the additional insurance amount, the coverage and the additional cost for the insurance. A check must be sent and payable to Precision Refining before the parcel will be returned.

Claims for Packages Originating at Precision Refining:

If a shipment originating at Precision Refining is lost and deemed unrecoverable, subject to the terms and conditions set forth herein, Precision Refining will be liable only for the least amount as established by one of the following three appraisal methods:

Precision Refining will pay the 120% of the liquidation value as previously established and offered by Precision Refining.

Precision Refining will pay 40% of the value of the contents with an accompanying appraisal through a qualified jewelry appraiser. Examples of a qualified appraiser would be a Certified Gemologist (CG), Registered Jeweler (RJ), Certified Gemologist Appraiser (CGA) or an Independent Certified Gemologist who’s sole business is appraising fine jewelry.

Precision Refining will pay the total sum of One Hundred Twenty Dollars ($120.00 USD) if shipped by way of USPS or through Federal Express.

Claims for Packages Originating at Customers Address

Shipments originating at the customers location as indicated on the Gold Kit address form and sent to Precision Refining by way of our USPS provided envelope or the Federal Express downloadable label with outside packaging provided by Federal Express or the customer, will be insured for up to $120.00 at no additional cost.

If your Federal Express parcel is dropped off at a Federal Express Ship Center, You must request a shipping receipt. A copy of this receipt will be required for reimbursement.

Claim Requests

A customer who wishes to submit a claim to Precision Refining must NOTIFY PRECISION REFINING IMMEDIATELY TO REQUEST A LOST PARCEL CLAIM FORM. In order for the claim to be processed, the form must be accurately completed in it’s entirety, signed and mailed to Precision Refining, Ltd. in accordance instructions included with the form. The customer must submit any and all supporting documentation with the completed and signed claim form. Failure to properly complete, sign and/or mail the claim form with adequate proof that the parcel was shipped to Precision Refining, will result in Us denying the claim. Any criminal intent to defraud Precision Refining Ltd. under the terms of this Agreement will be prosecuted under the full extent of the law.

Risk of Loss

Seller assumes the risk-of-loss for the products until delivery of the same to Precision Refining. Packing and shipping recommendations should be followed to avoid possible damage or loss.  You are responsible for any damages that may occur to your product while in transit.

Risk-of-Loss only passes to Precision Refining upon Precision Refining imaging or video taping the opening of the package in which the product was sent by You. If Precision Refining denies your offer to purchase your product, risk-of-loss will be transferred to You at point of return delivery to You by Precision Refining, provided, pursuant to these terms and conditions, You request the return of the product.

Accuracy of Information

Precision Refining makes every effort to ensure the accuracy of all information is presented on it’s website, literature or any communication. In the event of typographical errors, technical inaccuracies, pricing errors or omissions, Precision Refining reserves the right to correct the error. If Precision Refining corrects an error that will have a material effect on our settlement offer, Precision Refining will provide You with the following options: (1) to continue with the transaction based on the corrected information; or (2) to cancel your transaction, in which case Precision Refining will promptly return your shipment.

Liability / Indemnification

The seller agrees to hold Precision Refining harmless and to indemnify Precision Refining regarding any other losses or damages, including any incidental, indirect, special, consequential, punitive damages, or loss of profit or opportunity; claims, demands, or actions for any subrogation claim brought by Seller’s insurance carrier, and, by submitting an item to Precision Refining and Seller expressly and specifically waives any such subrogation claim on his or her behalf as well as on the behalf of his or her insurance carrier. By mailing a parcel of material to Precision Refining for analysis, the Seller explicitly and expressly accepts this limitation of liability.

EXCEPT AS EXPRESSLY STATED IN THIS AGREEMENT, PRECISION REFINING DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, ORAL OR WRITTEN, WITH RESPECT TO ANY AND ALL SERVICES RENDERED TO SELLER, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY AND/OR FITNESS FOR A PARTICULAR PURPOSE. PRECISION REFINING SHALL IN NO EVENT BE LIABLE TO SELLER OR ANY THIRD PARTY FOR ANY LOSS OF PROFITS OR FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE SERVICES PROVIDED TO SELLER UNDER THIS AGREEMENT, IN THE USE OF THIS WEBSITE OR OTHERWISE.

Indemnity Regarding Use of Website

You agree to indemnify and hold Precision Refining, its officers, directors, shareholders, predecessors, successors in interest, employees, agents, subsidiaries and affiliates, harmless from any demands, loss, liability, claims or expenses (including but not limited to attorneys’ fees and costs), made against Precision by any party due to or arising out of or in connection with your use of the website.

GENERAL PROVISIONS:

Entire Agreement/No Waiver.

These Terms of Service constitute the entire Agreement of the parties with respect to the subject matter hereof. No waiver by Precision Refining of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.

Correction of Errors and Inaccuracies.

The Content may contain typographical errors or other errors or inaccuracies and may not be complete or current. Precision Refining therefore reserves the right to correct any errors inaccuracies or omissions and to change or update the content at any time without prior notice. Precision Refining does not, however, guarantee that any errors, inaccuracies, or omissions will be corrected.

Modification

Precision Refining reserves the right to modify this Agreement at any time without giving You prior notice. Your use of the service and following any such modification constitutes your Agreement to follow and be bound by the Agreement as modified. The last date these Terms of Service were revised is set forth below. Terms and conditions modifying the Agreement are effective immediately upon posting. By either clicking SUBMIT on the Precision Refining website or by telephoning, faxing, emailing, or writing to Us to make a request, confirms that You agree that any action at law or inequity arising out of or relating  to these terms and conditions will be filed only in the state or Federal court located in the State of Illinois, and You hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action, or proceedings arising out of these terms and conditions. 

The above terms and conditions are governed by and construed in accordance With Illinois law, and no conflict of laws or provisions of any jurisdiction will apply to these terms and conditions. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to Seller’s use of the services provided by Precision Refining of action must be filed within 60 days after such claim or cause of action arose or be forever barred.

This writing constitutes the entire Agreement between the parties and there are no other oral or collateral agreements or any kind or character except those contained herein. This Agreement may be changed or modified only by written agreement signed by Precision Refining.

Other

You agree that You provided to Us your most current email address, physical address, and telephone numbers in which we can contact You, and it is your responsibility to provide Us with updated contact information. You further agree that any email message that we send to You, not returned by our mail servers, is deemed to have been effectively received by You and constitutes due notice to You by email. It is also further agreed that any phone message we leave with You or any individual answering your phone, on your answering machine or answering service, is effectively received by You and constitutes due notice to You has been given by telephone.

All references to days throughout all communication shall refer to business days. Saturdays, Sundays, and federal legal holidays are not included as business days, and if the expiration of any time frame set forth above falls on a Saturday, Sunday, or federal legal holiday, performance will be due on the next business day. Merchandise received on any Saturday, Sunday, or federal legal holiday will be considered to have been received on the next business day. All business days will begin at 8:00 AM CST and end at 5:00 PM CST.
